An Exclusion Order is a document issued by the Canadian government that prohibits a person from entering Canada. This document is usually issued to individuals who are deemed to be a threat to the security, health, or safety of Canadians. It is also issued to those who have committed a serious crime or have been involved in organized crime. If an individual had previously found to have misrepresented material facts on visa applications, he/she could also be issued this order.
Exclusion Orders are issued by the Minister of Immigration, Refugees and Citizenship Canada (IRCC) and are usually valid for a period of one year. The Order can be extended for up to three years if the individual is deemed to be a continuing threat to Canada. In case of misrepresentation, the current Exclusion Order is issued for 5 years.
Individuals who are subject to an Exclusion Order are not allowed to enter Canada, even if they have a valid visa or other travel document. They are also not allowed to apply for a visa or other travel document to enter Canada.
Exclusion Orders are issued for a variety of reasons, including:
- Security: Individuals who are deemed to be a threat to the security of Canada, including those who have been involved in terrorism or espionage.
- Health: Individuals who are deemed to be a threat to the health of Canadians, including those who have a communicable disease or are a drug user.
- Criminality: Individuals who have been convicted of a serious crime or have been involved in organized crime.
- Human Rights Violations: Individuals who have been involved in human rights violations, including those who have been involved in war crimes or crimes against humanity.
- Maintaining Immigration System Integrity: Individuals who have provided falsified documents and misleading information that could induce an error in the administration of the Immigration and Refugee Protection Act, and its Regulations.
Exclusion Orders are issued on a case-by-case basis. Individuals who are subject to an Exclusion Order may be able to appeal the decision or apply for a Temporary Resident Permit (TRP), or an Authorization to Return to Canada (ARC).
Exclusion Orders are an important tool for the Canadian government to protect the safety and security of Canadians. It is important for individuals to understand the implications of an Exclusion Order and to comply with the terms of the Order.
