Coming to Canada to work is getting easier

To address the national-wide labour shortage in Canada, the government of Canada has announced that starting April 4, 2022, several changes are made to the Temporary Foreign Worker Program (TFWP).

  • Labour Market Impact Assessment (LMIA) are valid for 18 months, up from the previously 6 months before the start of COVID pandemic.
  • Extended the maximum employment duration of High-wage and Global Talent Stream workers to three years, from previously two years. This will allow more workers to qualify for more permanent resident (PR) pathways.
  • Seasonal Cap Exemption will be made permanent, meaning for low wage positions in seasonal industries, there is no limit on positions to be filled. Maximum duration for these positions is extended to 270 days from 180 days.

Starting April 30, the following changes apply.

  • Employers of eligible sectors can hire up to 30% of their labour force from TFWP for one year. All other sectors can hire up to 20% until further notice (up from 10%).
  • Ended the automatic LMIA application refusals on low-wage sectors of unemployment rate of 6% or higher.
